General Rental Agreement

DIGITAL RENTAL AGREEMENT

Responsibility and Use & Disclaimer Warranties:

I, hereby acknowledge and agree to the terms and conditions outlined in this Rental Agreement ("Agreement") with "Party Factory".

Responsibility and Use: I understand that I am solely responsible for the proper use and operation of the rented items. I acknowledge and assume all risks associated with the operation and use of the rented items, and I agree to indemnify and hold "Party Factory" harmless from any claims for damage to property or bodily injury arising from such use.

Disclaimer Warranties: I acknowledge that no warranties, expressed or implied, including but not limited to merchantability or fitness for a particular purpose, have been made in connection with the equipment rented.

Equipment Failure:

I agree to discontinue the use of rented items immediately if they become unsafe or in a state of disrepair. I will promptly notify "Party Factory" of any such issues. "Party Factory" agrees to rectify the situation at its discretion, but I understand that they shall not be responsible for any resulting injury or damage.

Use of Equipment:

I agree to use the rented items only at the specified address and for their intended purpose. Subleasing or improper use is strictly prohibited. I confirm that I have familiarized myself with all instruction manuals, operating instructions, and warnings related to the rented items.

Equipment Responsibility:

I accept responsibility for the rented items from the time of possession until their return. I assume the risk of loss or damage, regardless of the cause.

Time of Return:

I understand that my right of possession terminates upon the expiration of the rental period specified in this contract. Any extensions must be agreed upon in writing.

Late Returns:

I agree to return the rented items to "Party Factory" promptly upon or prior to the expiration of the rental period. Failure to do so will result in continued rental charges until the items are returned.

Payment:

I acknowledge that all charges payable under this contract have been made upfront at the time of reservation.

Additional Charges:

In addition to other charges and cost provided herein, renter shall pay charges in accordance with company rates then in effect for the following services. Delivery and/or Pickup to any location other than level ground. Set up of tables and chairs. Delivery and Pickup after business hours, Saturdays, Sundays, and Holidays. Packaging materials not returned. Service calls. Site survey and preparation.

Delivery & Pickup:

I understand that I am responsible for cleaning and repackaging the rented items for pickup by "Party Factory". Delivery and pickup will be scheduled at the convenience of "Party Factory", and I agree to pay any associated service charges.

Care of Equipment:

I agree to protect the rented items from damage or loss while in my possession and to pay a reasonable cleaning charge for items returned dirty.

Insurance:

I understand that I am responsible for maintaining liability, property, and casualty insurance coverage for the rented items.

Site Preparation:

I agree to have the site prepared for the delivery and installation or pickup of the equipment and to pay any additional charges for delays or labor resulting from my failure to do so.

Permits & Licenses:

I agree to obtain any necessary permits and licenses prior to the installation of rental equipment, at my own expense.

Subsurface Conditions:

I agree to obtain locates of underground utilities before delivery of rented items and to reimburse "Party Factory" for any additional costs incurred due to undisclosed subsurface conditions.

Hold Harmless Agreement:

I agree to hold "Party Factory" and its staff harmless from any claims, losses, liabilities, damages, costs, and expenses arising from the use of rented equipment.

Damage Waiver:

I acknowledge the damage waiver charge specified in this contract and understand its limitations and exclusions.

Returned Checks:

I understand that there will be a charge of $35.00 for any returned checks.

By checking the box, I confirm that I have read, understood, and agree to abide by all the terms and conditions of this Rental Agreement.
